Penalties and procedures

The respective Act provides penalties and procedure for any type of offences. As explained under the following sections:

  • Section 22:
  • Obstructing an officer in charge of his duties, under the Act. Also if wilfully neglecting the inspector or a reasonable facility for any examination, inspection or enquiry under the Act.
  • Refusing to produce the records or registers on the demand of an inspector in charge.

Penalties And Procedure

  • Section 23:
  • Contravening the provisions of the act, or any rule made: prohibiting or restricting the contract labour’s employment. Also, if contravening the terms & conditions of a license granted under the Act.
  • Section 24:
  • Contravening the provisions or any rules of the Act. For which no penalty is provided.

Offences by the companies

Under this Act, imprisonment for a term may extend to three months. Or fine of around rupees thousand.

If the offence is committed by the person under the Act is a company. Thus, the company and everyone involved in the company deemed to be guilty of the offence. Therefore, shall be liable to punishment under the Indian penal court.

Hence, it doesn’t stand anything contained in sub-section (1) of the Act. Where the company is found guilty of committing an offence with the consent of that the commission of the offence is attributable to any neglect on the part any head officer, deem to be guilty of that offence. Thus, shall be liable to fine or punishment under the Indian penal court.
