Medical examination

Under section 11 of the Act, a medical examination is mandatory in case of an accident in the work premises. When a notice has been given by an employee of an accident. If the employer offers to have him examined free of charge by a qualified medical practitioner. Then s/he shall before the expiry of 3 days from the time at which service of the notice has been in effect. Submit himself for such examination. While under this Act if any employee who is in receipt of half-monthly payment shall, if required, submit himself for such examination from time to time as per the rules under the Act.Medical Examination

The right of an employee for claiming compensation suspends. If, s/he refuses to appear for examination by a qualified medical practitioner. Or tries to obstruct the same in any way.  Unless is successful in providing with the sufficient causes of him/her for not appearing for the respective examination.

Also, just in case if an employee without the medical examination voluntarily leaves the vicinity of the place. Where s/he had the employment, then his right to compensation legally suspends. Until s/he returns, and offers him/herself for such examination.

Under section 2 with sub-section 3 if an employee dies, whose right for compensation has been suspended, without submitting him/herself for the medical examination, then the Commissioner may, if he thinks fit, direct the payment of compensation to the dependants of the deceased employee.
