Compliances under the Act

The establishment or the factory must ensure the following compliances under the Act. While the compliances are illustrative, and not exhaustive.

  • The number of employees, who are having the entitlement to a bonus in any department/undertaking.
  • The number of employees, who aren’t having any entitlement to any bonus in view of their having worked for less than thirty days in total, during an accounting year.

Compliances Under The Act

  • The establishment or factory didn’t pay a bonus to – the employees providing their dismissal from the service, fraud, rebellious behaviour in the work premises, sabotage of any property or any theft.
  • The Establishment makes deductions from the amount of bonus payable under PBA in respect of employees in view of their founding guilty of misconduct causing financial loss to the Establishment. The quantum of deduction was only to the extent of the amount of loss suffered by the Establishment.
  • Computation of the gross profit and available surplus in accordance with the provision. By the establishment or factory with the rules made thereunder.
  • The opening of a separate bank account, during the accounting year, by the establishment or factory for transfer of unpaid/ unclaimed bonus in respect of employees. Who have either not been paid bonus for any reason or not collected their bonus. For the accounting year ended on 31st March 20 with Bank (Branch). The concerning welfare board deposits the non-payment (or no claims from the employees) of bonus.
