The Contract Law

The Contract Law

Let us discuss the Contract Law. Quid Pro Quo is a Latin maxim. The meaning of this is “consideration”, in a real sense. The literal meaning of the maxim “quid pro quo” is: “something in return of something” or “something in exchange for something” or simply “something for something”. Indian Contract Act frames and validates the contracts or agreements between various parties. Contract Act is one of the central laws that regulate and oversee all the business wherever there is a case of a deal or an agreement.

The Contract Law- Covenant of good faith – In contract law, the implied covenant of good faith and fair dealing is a general presumption that the parties to a contract will deal with each other honestly, fairly, and in good faith, so as to not destroy the right of the other party or parties to receive the benefits of the contract.

The covenant of good faith ‘uberrimafidei’ is an integral part of every contract. Asking for sexual favors, creating a hostile work environment, behavior which makes her uncomfortable, wrongful termination for rejecting sexual advances, or coerce her to resign by creating such an atmosphere at the workplace is just like a breach of this good faith doctrine.
