THE EMPLOYMENT EXCHANGES (COMPULSORY NOTIFICATION OF

VACANCIES) ACT, 1959 

The enactment of The Employment Exchanges (Compulsory Notification of Vacancies) Act, 1959 was done in the respective year. By the employers to provide for compulsory notification of vacancies to the Employment Exchanges.  And for the rendition of returns relating to the Employment Situation. With effect from 1st May 1960, this Act came into force. All Establishments in Public Sector and those of in the private Sector excluding the Agriculture.

EMPLOYMENT EXCHANGES (COMPULSORY NOTIFICATION OF VACANCIES) ACT, 1959

Where the employment of ordinarily 25 or more persons is there come within the purview of the Act. Other than those exempted these establishments are required to notify all vacancies to the appropriate Employment Exchange as notified in the official Gazette by the State Government in the prescribed format.

Although this Act will not apply to vacancies in any employment in unskilled office work, agriculture including horticulture, domestic service, employment in connection with the staff of parliament. And also, if the total duration of the vacancies is less than three months. Also, rendering quarterly Employment return by the establishments are required in Form ERI for every quarter ending 31st, March, 30th June, 30th September and 31st December.

Once in two years returns in Form ER-II the biennial occupational viz. By the Private Sector in odd years and by Public Sector in even years. Persons authorized by the Government shall have access to any relevant records of the employer, as per the provisions of this Act. Hence, they have the empowerment to inspect or take copies of relevant records or document. Thus, for various provisions of this act, penal provisions of the imposition of a fine for any offence have been made for violation.
