Penalties

If any of the following is committed by the employee or the employer. Then, penalties are charged under the Act.

  • If any of the provisions of this Act or the rules made by the supreme authorities, gets Contravened, or
  • To comply with the direction or requisition, if given a direction or any requisition.

Under the Act, s/he shall be punishable with imprisonment. For a term which may extend to six months. Or s/he may be charged with a fine which may extend to one thousand rupees or with both.

Penalties

Under section 29, of the Act, if the offender is a company, then every person involved in that particular organization will be held responsible. At the time of offence committed, every single person including the in-charge or responsible for to the company for the conduct of business, of the company as well as the company

Then they shall be deemed to be guilty of the offences happened. And they shall be liable for the punishment or fine, accordingly under the Indian penal court. However, if a person gets success in proving his/her innocence. Then such a person shall not be liable to any punishment. Also, he succeeds in proving, that everything happened, without his knowledge. Also, that all due diligence was exercised for preventing the commission of such offence.
