{"id":55335,"date":"2017-05-19T13:17:49","date_gmt":"2017-05-19T07:47:49","guid":{"rendered":"http:\/\/www.vskills.in\/certification\/tutorial\/?p=55335"},"modified":"2024-04-12T14:20:22","modified_gmt":"2024-04-12T08:50:22","slug":"payroll-manager-tutorial-payment-of-gratuity-act","status":"publish","type":"page","link":"https:\/\/www.vskills.in\/certification\/tutorial\/payroll-manager-tutorial-payment-of-gratuity-act\/","title":{"rendered":"Payroll Manager Tutorial | Payment of Gratuity Act"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large\"><a ref=\"magnificPopup\" href=\"https:\/\/www.vskills.in\/certification\/tutorial\/wp-content\/uploads\/2020\/12\/Certified-Selenium-Professional-77.png\"><img loading=\"lazy\" decoding=\"async\" width=\"750\" height=\"400\" src=\"https:\/\/www.vskills.in\/certification\/tutorial\/wp-content\/uploads\/2020\/12\/Certified-Selenium-Professional-77.png\" alt=\"Payment of Gratuity Act\" class=\"wp-image-95869\" srcset=\"https:\/\/www.vskills.in\/certification\/tutorial\/wp-content\/uploads\/2020\/12\/Certified-Selenium-Professional-77.png 750w, https:\/\/www.vskills.in\/certification\/tutorial\/wp-content\/uploads\/2020\/12\/Certified-Selenium-Professional-77-300x160.png 300w\" sizes=\"auto, (max-width: 750px) 100vw, 750px\" \/><\/a><\/figure><\/div>\n\n\n<h3>\u00a0<\/h3>\n<h3><strong>Payment of Gratuity Act<\/strong><\/h3>\n<ul>\n<li>Short title and commencement.-(1) these rules may be called the Payment of Gratuity (Central) Rules, 1972.<\/li>\n<li>These rules shall come into force on the 16th September, 1972;<\/li>\n<li>-In these rules, unless there is anything repugnant in the subject or context,-<\/li>\n<li>\u201cAct\u201d means the Payment of Gratuity Act, 1972 (39 of 1972);<\/li>\n<li>\u201cAppellate authority\u201d means the Central Government or the authority specified by the Central Government under sub-section (7) of section 7;<\/li>\n<li>\u201cForm\u201d means a form appended to these rules;<\/li>\n<li>\u201cnomination\u201d means nomination made under section 6;<\/li>\n<li>\u201cSection\u201d means a section of the Act.<\/li>\n<li>Notice of opening, change or closure of the establishment. &#8211; (1) within thirty days of the rules becoming applicable to an establishment, a notice in Form A shall be submitted by the employer to the controlling authority of the area.<\/li>\n<li>A notice in Form B shall be submitted by the employer to the controlling authority of the area within thirty days of any change in the name, address, employer or nature of business.<\/li>\n<li>Where an employer intends to close down the business he shall submit a notice in Form C to the controlling authority of the area at least sixty days before the intended closure.<\/li>\n<li>Display of notice.-(1) The employer shall display conspicuously a notice at or near the main entrance of the establishment in bold letters in English and in a language understood by the majority of the employees specifying the name of officer with designation authorized by the employer to receive on his behalf notices under the Act or the rules.<\/li>\n<li>A fresh notice shall be displayed immediately after the notice referred to in sub-rule (1) becomes illegible or requires a change.<\/li>\n<li>Form of notice under proviso to section (2) (h) (ii).-(1) A notice under the proviso to sub-clause (ii) of clause (h) of section 2 shall be in Form D and sent in triplicate by the employee to the employer, who shall, after recording its receipt on one copy thereof, return the copy to the employee and send the second copy to the controlling authority of the area<\/li>\n<\/ul>\n<p>\u00a0<\/p>\n<table>\n<tbody>\n<tr>\n<td width=\"20\">1\n<p>\u00a0<\/p>\n<p>\u00a0<\/p>\n<\/td>\n<td width=\"540\">Vide G, S.R. 412 (E).
